THE SUPREME COURT IS AN OBSTINATE ASS! AHMAD LAWAN IS DOWN AND OUT!

The Nigerian Supreme Court is in the news again for bad reasons. Conflicting judgements have resulted in respect of a suit filed by the All Progressives Congress (APC), at the apex court on behalf of its out-going Senate President who resorted to return to his constituency and reclaim his former seat already filled by a fresh candidate having failed in the party's Presidential Primaries!

Ahmad Lawan had been in the Legislature from, 1999-2023 as the representative for Yobe North but decided to up his game to the Presidency in the expected up-coming general elections.
The Yobe North Senatorial Seat which is in contention between Senate President Ahmad Lawan and a greenhorn Bashir Machina was litigated at the Lower and Upper Courts in favour of the latter.

 Bashir physically participated in the All Progressives Congress (APC), party primaries conducted on 28th May 2022, won and his name submitted to INEC according to Section 29 of the Electoral Act 2022.

On the other hand, Mr. Lawan voluntarily withdrew from the senatorial primaries of 28th May 2022 and opted for the presidential primaries of the APC of 8th June 2022 and lost! 
Having lost his bid for the top-most position, Mr Lawan manipulated fresh primaries for the Yobe North Senatorial District slot with the tacit connivance of the Electoral Umpire, the Independent National Electoral Commission (INEC), on 9th June 2022 and was declared the winner!

SPLIT JUDGEMENTS OF THE FIVE APPEAL COURT JUDGES!

The lead Judge claimed that both court processes filed against Lawan at the Federal High Court Yobe and the Appeal Court in Abuja were "abuse of court processes," , and that they were "perverse and must be set aside".
He also said that Macchina should have commenced his suit by a writ of summons going by the allegations of fraud leveled against the APC by transmitting Mr. Lawan's name to INEC.

However the dissenting Judges maintained that the APC lacked merit and fined the Party a sum of NGN3 million in favour of Macchina!

CAN ANYTHING GOOD COME OUT OF A CORRUPT JUDICIARY?

*Who will redeem the image of the Nigerian Judiciary which table rest the hope of the common man?
* Should any Nigerian be surprised at the conflicting judgements of the Apex Court?
* If Lawan could pay a whopping unrefundable sum of NGN100 million naira to purchase APC Interest Form to become Nigeria's next President, what amount would be too much for him to purchase corrupt Judges of the THIRD ARM!

It is in the public domain that during the first term administration of Major General Muhammadu Buhari, senior judges including those of the Supreme Court were humiliated and disgraced by operatives of the Department of State Security (DSS), in a STING OPERATION which exposed them as corrupt officers of the law!
The disciplinary body of Judges, the National Judicial Council (NJC), was deliberately sidelined in order to catch the corrupt judges by surprise and so they did!
*BUT IT WAS AN EXERCISE IN FUTILITY AS WE PREDICTED THEN IN 2016 THAT THE CULPRITS WOULD BE SET FREE!

Although most of them were caught red- handed with monetary evidences and unexplainable "gifts" of exotic vehicles and millions of foreign currencies in various denomination, "kagaroo courts" headed by the fraternity of judges set all of them free to go home and enjoy their loots!

INCUMBENT CHIEF JUSTICE ARIWOOLA IS STANDING ON THE "BANANA PEEL" AND IT MAY NOT BE TOO LONG BEFORE HE FALLS FLAT!

Chief Justice Olukayode Ariwoola started on the wrong footing by frolicking, socializing and reveling with politicians BUT, the Supreme Court of Nigeria Director Press and Information, in a very lengthy statement at the week end condemned all criticisms against the latest judgement in favour of Mr. Lawan who has brought Nigeria into more ridicule among the comity of nations for his unbridled. LUST for ephemeral power and transient positions!

It is not in dispute that there are eminent jurists with impeccable character, moral principles. Integrity, diligence, commitment to high standards within the current Judiciary of Nigeria but those who have thrown caution to the winds in preference of immorality and corruption MUST be purged and excised from the SYSTEM!

The following statement credited to Justice Ayo Salami, a retired judge of the Appeal Court is relevant to counter many many criticisms against the Nigerian Judiciary;
" The Nigerian judiciary harbours corrupt elements who are politicians and government apologist who attend all manner of social gatherings and frolic with litigants with pending cases before the High Courts.....How can judges decide cases against their political parties and people they wine and dine with he queried?"

AT THE MOUTH OF TWO OR THREE WITNESSES, A MATTER IS CONFIRMED!

Who will purge the JUDICIARY of this CORRUPTION STIGMA? Definitely not the propaganda of the Director of Press and Information!

OUR RECOMMENDATIONS:
Before Major General President Muhammadu Buhari departs office on 29th May 2023, he should follow up on his FIRST TERM PETITION TO THE JUDICIARY IN WHICH HE MADE THE FOLLOWING SUBMISSIONS;
1) The Learned Benchers should be forefront in the forefront to develop right- based jurisprudence as an element of the multidisciplinary approach advocated in the fight against corruption by enforcing applicable laws to avoid delay in ensuring criminal Justice administration.
2) The Apex Court should intensify the reforms introduced through the criminal justice act of 2015 and discourage lawyers who were out to frustrate the reforms for a change of attitude collective action in building a new Nigeria.
3)  In view of the dwindling Revenue, the Judiciary should support in tackling the two ILLS - WASTE AND CORRUPTION simultaneously.
4) Can the Nigerian Supreme Court provide refuge and justice to the aggrieved while it regularly dines and wines with the high and mighty of the society? This very salient question has been asked severally in the past but it seemed that the Judiciary had developed thick skin against public criticisms and outcries in respect of its dented image!
5) BUT We believe that it was high time that the present crop of the entire judiciary looked inwards and introspect in order to shore up a new/impeccable identity that should uplift this very weak arm of government to the pedestal.
6) And whereas the duty of the Judiciary as the third arm to the Executive and the Legislative is clearly spelt out in the military 1999 Constitution of the Federal Republic of Nigeria in respect of ensuring equity legislation and human rights adjudication.
7) The three arms of government should work together as a team to ensure good governance and sovereignty to the people based on the principles of democracy and social justice while the security and welfare of the people should always be the primary purpose of the three arms.
8) The Judiciary should also serve as the arbiter between the Executive and the Legislature and THE LAST HOPE OF THE COMMON MAN IN REALITY!
