IN 2023 APEX COURT DECLARED TINUBU PRESIDENT - WHAT OF 2027?
Since the brokerage of a nascent democracy between the Military and Citizens through the 1999 Nigerian Constitution, the Court ultimately assumed sole authority on which desk the final decision on political offices were concluded.
Although the Nigerian Supreme Court’s Verdict of 2023 favored Mr. Bola Tinubu who woefully failed to meet the Constitutional requirements of 25% of total votes cast at the Federal Capital Territory (FCT), and he was declared winner with 19% score. The Labor Party Candidate, Peter Obi was the actual overall winner with 59% score in Four out of the Six Area Councils - Gwagwalada, Abaji, Kwali, Kuje, Bwari and Abuja Municipal Area Council (AMAC).
Mr Obi secured 281,717 votes, Bola Tinubu of the ruling All Progressives Congress (APC), polled 90,902 votes while Atiku Abubakar of the PDP got 74,199 votes respectively.
WHAT DOES THE CONSTITUTION SAY ABOUT THE WINNING MARGIN?
Section 134 (1) and (2) of the 1999 Constitution of Nigeria (as amended) stipulates that a presidential candidate must attain or score a majority of votes cast in a presidential election, where two or more candidates are involved, and at least 25% in two-third of the 36 States and Federal Capital Territory (FCT) of Nigeria to meet the constitutional requirement to be declared as duly elected as President of Nigeria.
The constitution is very explicit and unambiguous in Section 134 (1) (2), which spelt out two-thirds of the 36 States and FCT as mandatory 25% votes.
APEX COURT’S KANGAROO VERDICT ON TINUBU’S VICTORY IN OCTOBER 2023!
The Supreme Court confirmed Bola Tinubu as winner of the February 2023 Presidential Election in spite of concrete evidences adduced by his opponents that he did not meet Constitutional percentage requirements!
The apex court also stated that Atiku Abubakar and Peter Obi’s petition against INEC for failing to electronically transmit results from polling stations to an online portal was also devoid of merits!
The petitioners argued then that Tinubu had won less than 25% of the votes in the Federal Capital, Abuja, short of the legal threshold to become president.
IN ALMOST THREE YEARS OF TINUBU’S ADMINISTRATION LOTS OF. DIRTY WATER HAVE PASSED UNDER THE BRIDGE!
As at the time of this publication, Nigeria has metamorphosed into a ONE PARTY STATE – All Progressives Congress (APC), has 31 States in its kitty; Peoples Democratic Party (PDP), 4 States; Labor Party (LP), 1!
Before commencement of the recent 2026 FCT Area Council Elections, all Labor and PDP Chairmen/Councilors “stepped down for APC Candidates” and won with no resistance!”
AND INEC CHAIRMAN Professor Amupitan’s Paper Result Sheets were the unavoidable result of electronic transmission glitches according to the INEC PORTAL publication!
THIS TIME AROUND TINUBU’S LITMUS TEST “SUCCESSFULLLY” DELIVERED FIVE OF THE SIX FCT LOCAL COUNCILS AND NYESOME WIKE FCT MINISTER HAS BEEN CONGRATULATED FOR THE HATCHET JOB!!
NB. Please find below other Supreme Court’s intervention in Political adjudications from 1999 to 2023!
1) 1999 - Chief Olu Falae still insists he won 1999 election by 1.5 million votes, claiming Obasanjo was imposed by military to protect interests. According to the Tehran Times of 6th April 1999 an Abuja Appeal Court dismissed the challenge filed in March by the former Finance Minister Chief Olu Falae who did not pursue the litigation to the Supreme Court.
2) 2003- A petition filed by former Military Head of State, 1983-1985, and presidential candidate of All Nigeria Peoples Party (ANPP), late General Muhammad Buhari before the Presidential Election Petition Tribunal sitting in Abuja on December 20th, 2004 challenging the re-election of Chief Olusegun Aremu Obasanjo was dismissed by the Supreme Court on 1st July 2005.
3) 2007-Nigeria’s Independent Electoral Commission (INEC) declared Umaru Yar’Adua of the People’s Democratic Party winner of the April 2007 election but the decision was challenged by two opposition candidates, General Muhammadu Buhari and former Vice President Atiku Abubakar who sought to nullify the votes because of widespread intimidation, disorganization and fraud. On November 1, 2009, The Nigerian Supreme Court adjourned without ruling on a challenge to the validity of the 2007 presidential election that brought President Umaru Yar’Adua to power but at his inauguration, President Yar’Adua acknowledged there were “lapses and shortcomings” in the elections, and promised to address the controversy.
4) 2011- The Supreme Court on December 28, 2011 in Abuja affirmed the decision of the Court of Appeal and upheld the victory of President Goodluck Ebele Jonathan in the Presidential Election which held on 16th April, 2011. In a unanimous decision, the Supreme Court held that Muhammadu Buhari who was the Presidential candidate of the Congress for Progressive Change, (CPC), failed to discharge the burden of proof placed upon it by the Electoral Act to prove its allegation that the Independent National Election Commission, INEC, did not conduct the election according to the provisions of the law. On his part, then President Jonathan welcomed the unanimous confirmation by the Supreme Court affirmation of his victory in the April, 2011 Presidential election.
5) 2015 The Presidential elections of 2015 was UNCHALLENGED at the Supreme Court because the incumbent President Goodluck Jonathan, CONCEDED DEFEAT and in an unprecedented phone call, congratulated Buhari! It was obvious from BUHARI’S winning streak of election results from all but one of the 36 states counted, that the candidate of the All Progressives Congress, was clearly in the lead, President Goodluck Jonathan telephoned him and concede defeat as a good sportsman!
6) 2023 – The Supreme Court gave victory to Bola Tinubu on a platter of GOLD as documented in earlier paragraphs!
BREAKING MEDIA REPORT ON FCT POLLS! APC NOW SCORED 6/6!
“In a dramatic post-election twist that is reverberating through Nigeria’s capital, Mr. Mohammed Kasim; the newly elected chairman of Gwagwalada Area Council in the Federal Capital Territory (FCT), has defected from the Peoples Democratic Party (PDP) to the ruling All Progressives Congress (APC) just days after being declared winner of the February 21 area council elections.
“ Independent National Electoral Commission (INEC) results had shown him securing the Gwagwalada chairmanship with 22,165 votes, defeating the APC’s Yahaya Shehu’s 17,788 votes in a keenly contested poll.
“Sources close to political circles in Abuja suggest Kasim’s defection was pre-negotiated with key stakeholders in the corridor of power, triggering controversy within PDP ranks and raising questions over democratic integrity at the grassroot.
Political analysts contend this move reinforces APC’s dominance ahead of the 2027 general elections while highlighting institutional fragilities within the opposition. As Dr. Aisha Bello, a governance expert at the Centre for Democratic Studies, observes, “Defections at the local level underscore the erosion of ideological coherence in Nigerian politics and signal a drift towards patronage-driven alignments rather than programme-based political competition.”
PDP has reportedly threatened legal action to contest the legitimacy of the defection on grounds that it undermines the electoral will of Gwagwalada constituents, insisting that allegiance shifts so soon after a mandate breach electoral norms.
CONCLUSION.
